Advocacy Works! Thank You Nonprofit New York for Leading An Incredible Campaign!

Nonprofit Westchester Members and Community,

Friday evening, Governor Hochul signed S4817a/A1141a, which repeals the redundant new double filing requirement for 501(c)(3) nonprofit organizations!

Thank you Governor Hochul, thank you to the bill sponsors Senator Krueger and Assemblymember Paulin. And thank YOU: our members, coalition partners, and sector peers who took action to collectively win this campaign. Over 800 of you emailed the Governor, and 460 of you signed on in support of this legislation. A special thank you to Pro Bono Partnership for taking an active role in this effort.

After close to two years of organizing, charitable nonprofits registered in New York will not have to file their 990s and accompanying documents to the Department of State in addition to the Charities Bureau of the Attorney General’s Office. Nonprofits will continue to file annually with the Charities Bureau, which has enforcement authority over the sector.

Nonprofit New York and the Lawyers Alliance for New York will hold a Policy Forum: What Does the Enactment of S4817a/A1141a Mean for Nonprofits? on Wednesday, November 17 from 3:00pm - 4:00pm. Assemblymember Amy Paulin, sponsor of A1141a, will join us to introduce the forum! The forum will provide an overview of  the proposed reporting requirement, discuss the successful advocacy strategies to repeal it, and clarify what nonprofits need to know about their filing obligations.

In early 2020, the state budget legislation included a new double filing requirement for charitable nonprofits registered in New York State, requiring them to file their annual 990 and accompanying documents to the NY Department of State in addition to the Charities Bureau of the Attorney General’s Office. The original budget legislation proposed that the Schedule B major donor list of nonpartisan charitable nonprofits would be published publicly, a violation of nonpartisan donors’ constitutional right to privacy established in NAACP v. Alabama (1958). While we were successful in preventing the blanket publishing of Schedule Bs, we were unsuccessful in preventing the new reporting obligation to file with the DOS to take place for the first time this year. This new burden on the sector was justified in terms of transparency but created no additional access to information. Nonprofits are keenly aware of the importance of public trust and work closely with the Attorney General’s office to ensure compliance with nonprofit ethics and regulations.

And That’s A Wrap
