NYS Guidance for Contracted Nonprofits, PPP Update, FEMA Funding

New York State Guidance for Contracted Human Service Nonprofits

Certain New York state agencies* will be able to amend contracts for nonprofit providers struggling to meet performance requirements because of the coronavirus. Nonprofits must document the impact of the COVID-19 outbreak on their respective agencies. The new rules apply to the following state agencies for contracts awarded before March 7.

*Agencies include only:

  • the Office of Children and Family Services (OCFS)
  • the Office of Temporary and Disability Assistance (OTDA)
  • the Office of Addiction Services and Supports (OASAS)
  • the Office of Mental Health (OMH)
  • the Office for People with Developmental Disabilities (OPWDD)
  • the State Office for the Aging (SOFA)
  • the Division of Criminal Justice Services (DCJS)
  • the Department of Labor (DOL)
  • the Department of Health (DOH).

NPW has been part of advocacy efforts spearheaded by the Human Services Council and other partners to ensure State-contracted providers have the information they need to safely modify their work and ensure contracts will still be paid.

Paycheck Protection Program Update

On April 6, the Treasury Department issued a FAQ with additional guidance, particularly regarding issues that NPW members expressed:

  • the calculation of average monthly payroll
  • definition of compensation in excess of $100,000 annually
  • gross pay/FICA and Federal Tax rules
  • previously submitted applications. 

Fiscal Management Associates have added updated guidance to their Paycheck Protection Program Toolbox. These tools have time stamps with latest updates. Media reports indicate that more funding for this program may be on the way.

FEMA Public Assistance Briefings

The Office of Disaster Recovery at the Division of Homeland Security and Emergency Services is continuing to hold Virtual Applicant Briefings for New York State through April 17th to discuss federal funding from FEMA that may be available under the COVID-19 major disaster declaration.
